What does the law say about the garage of the condominium?
In accordance with Brazilian Federal Law 12,607, the sale or rental of parking spaces is prohibited, except where the approval of two-thirds of the members of the assembly at a meeting. Created in 2012, the legislation affects both residential and commercial condominiums. See what Article 1331 says:
“Parts which may be used independently, such as apartments, offices, shops and overshoes, with their respective ideal fractions in the ground and other common parts, are subject to exclusive ownership and may be freely sold or burden by their owners, except the shelter for vehicles, which may not be sold or rented to persons outside the condominium, unless expressly authorized in the convention.”
The Civil Code also establishes three types of parking spaces. They are:
Autonomous: Registered in the notary’s office and for the exclusive use of the owner, which can be rented or sold if the convention allows;
Bounded: which, although it is also a type of private property, has no registry, so can’t be sold or rented;
Common use: ie it does not belong to any resident, so it is forbidden to sell or rent.
